1. Who we are and who controls your data

This Privacy Policy explains how we handle personal information in connection with the Forked.gg platform, websites, applications, community services, and related products (together, the "Platform"). The data controller is Helix Games Inc., a Panama corporation (Public Registry of Panama Folio No. 155768673), which operates the Platform and FORKcast, its predictive engine. For matters relating to the $FORK token, the controller is The Helix Games Foundation (Folio No. 25061724). Both are organized in the Republic of Panama. References to "we," "us," or "Forked.gg" mean the relevant entity for the activity in question.

2. What this policy covers

This policy covers personal information we handle through:

  • the Forked.gg websites and the FORKcast web application, including accounts, points play, watch parties, and chat;
  • our Discord community services, including the engagement bot that awards community points and the bot that lets you link a wallet address to your Discord account;
  • the Forked.gg marketplace and other product surfaces we operate;
  • emails and other communications between you and us.

Third-party services we link to or embed, such as Discord itself, Twitch, YouTube, Kick, and your own crypto wallet, are governed by their own privacy policies, not this one.

3. What we collect

Information you give us

  • Waitlist. The email address you submit, and any consent choice you make.
  • Account. Your email address, a username or display name, and a password, which we store only as a salted hash, never in plain text.
  • Community participation. When you use our Discord community, we process your Discord user ID, username and display name, and the content of messages you post in channels the bot reads, which is used to award community points and to surface ideas and feedback.
  • Wallet linking. If you link a wallet, we store the blockchain wallet address you provide together with your Discord identity, so we can recognize you for community rewards and eligibility.
  • Communications. Whatever you choose to send us, such as your email address and the contents of your message.

Information from your use of the Platform

  • Gameplay and points data. Your activity in FORKcast, including markets you create or join, points you stake, resolutions, and your standing and leaderboard position.
  • Chat and rooms. Messages you post in stream chat or in a watch-party room, and your membership of rooms you create or join.
  • Technical and usage data. Information collected automatically when you use the Platform, such as your IP address, device and browser type, pages and events viewed, and log and diagnostic data.
  • Local storage. Small amounts of data stored in your browser to make the Platform work, for example to keep you signed in or to remember a prior wallet connection.

What we do not collect

FORKcast is points-only with no cash component, so we do not collect payment-card numbers, bank details, or other financial-account information through it, and we do not require identity documents to play. We do not knowingly collect information from anyone under 18. If a cash component or a live-token feature is introduced, additional information, including identity and verification data for KYC/AML, may be required, and we will update this policy before any such feature launches.

4. How we use it

  • to provide, operate, and maintain the Platform, your account, and our community services;
  • to run FORKcast, including markets, staking, resolution, chat, watch-party rooms, and the leaderboard;
  • to award and administer community points, including reading and scoring community messages, and to recognize linked wallets for eligibility;
  • to contact waitlist subscribers when a product becomes available, and to send service and product-update messages;
  • to measure and understand how the Platform is used, so we can improve it;
  • to keep the Platform secure and to detect, prevent, and address fraud, abuse, and violations of our Terms;
  • to comply with legal obligations and enforce our agreements.

5. Legal bases for processing

Where data-protection law such as the EU or UK GDPR applies, we rely on these legal bases:

  • Performance of a contract, to create and run your account and provide the Platform and community features you use;
  • Consent, for waitlist and product-update emails and for any non-essential analytics or cookies where consent is required, which you can withdraw at any time;
  • Legitimate interests, to secure, measure, and improve the Platform, to award community points fairly, and to prevent abuse, where these interests are not overridden by your rights; and
  • Legal obligation, where the law requires the processing.

6. Automated processing and AI

To award community points, messages posted in our Discord community channels are scored automatically, which includes sending the message text to an artificial-intelligence service provider acting as our processor for the sole purpose of rating contribution quality and surfacing ideas and feedback. This scoring affects only your in-community points standing. It does not produce any legal effect or similarly significant effect on you, and we do not use it to make decisions about your access to money, credit, or any external benefit. We do not sell this content, and the provider is contractually limited to processing it for us.

7. Cookies, local storage, and analytics

The Platform uses browser storage that is necessary to make it function, such as keeping you signed in or remembering a prior wallet connection. We also use privacy-focused, self-hosted analytics (running on our own infrastructure rather than a third-party cloud) to understand which pages and features are used, so we can improve the Platform. This analytics may process your IP address and browser type to produce aggregate usage statistics. We do not use advertising cookies or cross-site tracking. Where consent is required in your jurisdiction before non-essential analytics runs, we will obtain it.

8. How we share it, and our processors

We do not sell your personal information. We share it only:

  • with service providers (processors) who handle data on our behalf under contracts that require them to protect it and use it only for the services they provide to us;
  • for legal and safety reasons, where we believe disclosure is required by law or necessary to protect the Platform, our users, or the public;
  • in connection with a business transfer, such as a merger, financing, or sale of assets, subject to this policy;
  • between the Foundation and the Company where needed for the activity in question, for example token distribution versus Platform operation.

The main categories of processor we use are:

  • Hosting and infrastructure, which process and store Platform data and request logs on our behalf;
  • Email delivery, to send account verification, password reset, and product-update emails;
  • An AI scoring provider, to rate community-message contribution as described in section 6;
  • Self-hosted analytics, as described in section 7.

Embedded stream players from Twitch, YouTube, and Kick, and your own wallet provider, receive data directly from your browser when you use those features, under their own privacy policies. A current list of our key processors is available on request at the contact address below.

9. International transfers

We operate from the Republic of Panama, and our service providers may handle personal information in other countries, including the United States. Panama and some of these countries are not the subject of an EU or UK adequacy decision. Where we transfer personal information of users in the EU, the UK, or the European Economic Area across borders, we take steps intended to give it a level of protection consistent with applicable law, and we are putting appropriate transfer safeguards in place with our processors. 10. Retention

We keep personal information only as long as needed for the purposes described here or as required by law. Waitlist emails are kept until the relevant product launches or until you ask to be removed. Account and gameplay data are kept while your account is active and for a reasonable period afterward, then deleted or anonymized. Chat messages, community-points records, and wallet links are kept while needed to run those features and prevent abuse, and we will remove them on request where we are not required to keep them. We are introducing defined retention limits for these records and will update this section as they take effect.

11. Security

We use reasonable technical and organizational measures designed to protect personal information, including storing passwords only as salted hashes and restricting access to community and wallet data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

12. Your rights

Depending on where you live, you may have rights to access, correct, delete, port, or restrict the processing of your personal information, to object to processing, and to withdraw consent at any time without affecting processing already carried out. This includes the right to ask us to unlink a wallet from your Discord identity. You can exercise these rights, or ask to be removed from the waitlist, by contacting us at the address below, and we will respond as required by applicable law. EU, UK, and EEA users also have the right to lodge a complaint with their local data-protection authority.

13. Users in the EU and UK

Because we are established outside the European Union and the United Kingdom and offer services to people there, EU, UK, and EEA users can contact us about how we handle their personal information at legal@forked.gg, and have the right to complain to their local data-protection authority. We are reviewing whether we are required to designate a representative under Article 27 of the EU and UK GDPR, and will name any representative we appoint in this section.

14. Children

The Platform is not intended for anyone under 18, and we do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.

15. Restricted jurisdictions

The Platform, the $FORK token, and node licenses are not offered to U.S. Persons or to other restricted persons or jurisdictions described in our Terms & Conditions, and the Platform is not directed to them.

16. Changes to this policy

We may update this policy from time to time. We will update the "last updated" date and, for material changes, provide notice on the Platform where appropriate. Your continued use after changes take effect constitutes acceptance.
